I haven't been here in a while. I was focusing on trying to get my life together, and things were starting to look up. We were finally approved for HUD (federal housing aid, for those not in the know / in the US), which was going to let us start getting on top of bills and past-due rent. However, earlier this month our landlord finally succeeded in finding a buyer for her properties. This wouldn't be a problem, except that on May 15th, the new owner told us we had to be out by June 1st. That's right, tomorrow. They want to clear us out so they can send in people to "rennovate" the house and jack up the rent to about double what we have been paying.

We're fairly sure this isn't sufficient time, legally. We're looking at places, but we have to wait on other people's pleasure in getting back to us. Obviously we haven't succeeded in moving out. We've already retained a pro-bono legal service, but I'm not sure how much they can do.

What we need is just a couple more weeks. We can't make other people move faster than they already are, and we have nowhere to go in the meantime. I wouldn't be worried, except I'm not sure that an eviction notice served to us would give us 30 days because of our being behind on the rent. We're trying to cooperate, but these people want more and faster than we can give and don't care what happens to us.

Any mojo to grease the wheels would be appreciated. As I said we've got some places we're looking at, one of which is very nearby and is already HUD-approved that I'd like to focus on. All we really need is a little more time than the new owners are willing to give.

I feel for you too. When I was 7 1/2 months pregnant with my 4th, we found a house to rent. It had been on the market for 6 years! But the owner was renting out untill it sold. I busted @ss cleaning up after the previous tenants mess. The carpet looked (and smelled) like about 5 pets and a couple of kids were using it as a toilet! 7 times I went over each of 5 rooms of carpet! I striped wallpaper, painted, striped and waxed floors too! All while very pregnant! We were there for 3 months then he sold it. The new owners gave us 2 weeks to move! We wound up moving in with my folks :( Lucky we had them to go to.

Best of luck in finding "the right place" soon. And better luck in holding the owners off!

i have beenthrough about 5 moves..all of them suck however none under those circumstances..my best wishes for a solution.

For what its worth I can tell you from experience California laws make a landlord give 30 days no matter how behind in rent the renter is. I will keep you in my prayers that the right people speed up and the wrong people slow down!

I'm so sorry you're dealing with such a horrible situation. Adding my energies to WR's wish that the right people speed up and the wrong people slow down. :hugz:


Now about the notice to move out... they may ask you to move sooner, but you should have 30 days if you're renting month-by-month.



NOTICE REQUIRED TO END A TENANCY OR RAISE THE RENT

If the tenant rents month-to-month, either the tenant or landlord can end the tenancy by giving notice 30 days before the rent is due. If the tenant rents week-to-week, either the tenant or landlord can end the tenancy by giving a seven day notice before the rent is due. The landlord can increase the rent by following the same notice procedures.
If the tenant is under a written lease for a term greater than one month, the lease ends at the end date of the lease, unless the lease states the lease will continue. Rent cannot be raised during the term of the lease.
ACTS PROHIBITED BY LAW

Lockouts: A landlord may not lock a tenant out of his/her apartment, shut off the utilities, take the tenant's belongings or use force to make the tenant pay rent or leave the apartment.

We've finally found a place, but we're not out of the woods yet.

We found it today, after a few days of talking to the owner, playing phone tag and so forth. We saw it early this afternoon and we liked it a lot, so we decided to take a chance on it. It's spacious and clean. It's not as nice as a place we looked at yesterday, but it's on a main bus line, near a store and a library, and just a couple minutes' walk from our friends. It also costs less than the other place.

The final remaining hurdle is the HUD inspection. The place looked just fine to me, with no damage, but there's always the possibility of something going wrong. We need this place, as we're running out of time. We really need this to go smoothly so we can get out of here.
